Were you aware that if a person is employed by you and needs to be granted permission to work in the UK but does not have that permission – you as the employer face a huge fine or even imprisonment?

The Immigration, Asylum and Nationality Act 2006 requires employers to check that an employee has the right to work in the UK before they commence employment with you. If it can be proved that you knew they had no official right to work here you face an unlimited fine and/or 2 years imprisonment.

Even an unwitting mistake can result in a £20K fine.

Make sure you check all documents thoroughly. Do take advice if you are not sure. Never issue an offer letter to someone who you have any doubts about as to their right to work in the UK. Keep copies of all documentation you are shown and make sure you see originals.
